Welcome to Agent Tools For Success ("ATFS," "we," "us," or "our"), a real estate training academy and coaching membership founded by Quiana Shonté Echols. These Terms of Service (the "Terms") govern your use of our website at https://agenttoolsforsuccess.net and your membership and participation in our programs, community, and courses.

By using our website or joining the membership, you agree to these Terms. If you do not agree, please do not use our website or services.

1. The membership

ATFS offers one membership with everything included. Membership provides access to our training, coaching, resources, the private member community hosted on Circle, and courses hosted on Thinkific, as described on our website at the time of your enrollment. Specific classes, sessions, and materials may change over time as programs are updated, added, or retired.

You must be at least 18 years old to join. Your membership is for your own use and may not be shared, transferred, or resold. You are responsible for keeping your login details confidential and for all activity under your account.

2. Billing

Price. Membership is $149 per month or $1,490 per year, as selected at checkout. There is no activation fee.
Auto-renewal. Membership is billed on a recurring basis and renews automatically at the end of each billing period (monthly or annual, as selected) until cancelled. By enrolling, you authorize us and our payment processor, Stripe, to charge your selected payment method on each renewal date.
Cancellation. You may cancel at any time. Cancellation stops future renewals and takes effect immediately. When you cancel, your access to the community, trainings, and all member content ends right away, not at the end of your paid period.
Refunds. All membership fees are non-refundable. This applies to monthly and annual plans, and it includes any partial period: because access ends immediately when you cancel, no refunds or credits are given for unused time. The only exception is where a refund is required by law.
Price changes. We may change membership pricing. If we do, we will notify you by email at least 30 days before the change applies to your next renewal.
Failed payments. If a payment fails, we may retry the charge and may suspend or end access until payment is received.
Prices are in US dollars and are exclusive of any applicable taxes. Taxes are charged as required by law.

3. Acceptable use

You agree to use the community, courses, and materials respectfully and lawfully. In particular, you agree not to:

Share your login or give non-members access to member content
Copy, resell, redistribute, or publicly post ATFS materials, except as permitted under Section 4
Harass, threaten, or abuse other members, trainers, or staff
Post content that is unlawful, defamatory, misleading, or infringes the rights of others
Use the community to send spam or unsolicited promotions to other members
Attempt to disrupt the website, community, or course platforms, or to access them in an unauthorized way

We may suspend or end the membership of anyone who breaches these Terms. If we terminate a membership for a material breach of these Terms, fees already paid are non-refundable.

4. Intellectual property

All ATFS content, including classes, recordings, scripts, presentations, templates, workbooks, and branding, belongs to Agent Tools For Success or its licensors and is protected by intellectual property laws.

Your membership gives you a personal, non-exclusive, non-transferable licence to use the materials for your own real estate business. You may not redistribute, resell, sublicense, publish, or share the materials with non-members, and you may not use the ATFS name or branding in a way that suggests endorsement or affiliation without our written permission.

Content and contributions that you post in the community remain yours. By posting them, you grant ATFS a non-exclusive licence to host, display, and share your content for the purpose of operating and promoting the community.

5. Results disclaimer

ATFS provides training and education only. We do not guarantee any income, sales, commission, or business result. Results described in testimonials, classes, or marketing materials reflect individual experiences and are not typical or promised results. Your results depend on your own effort, experience, market conditions, and other factors outside our control.

Nothing provided by ATFS is legal, tax, accounting, or financial advice, and nothing creates a brokerage, agency, fiduciary, or professional advisory relationship between you and ATFS. You should consult your own qualified professionals, and comply with the licensing laws, brokerage policies, and MLS and association rules that apply to you, before acting on any training content.

6. Third-party services

The membership is delivered in part through third-party platforms, including Circle for the community, Thinkific for courses, Stripe for payments, Kit for email, and HighLevel for messaging and customer management. Your use of those platforms is also subject to their own terms and policies. We are not responsible for outages or changes on third-party platforms, although we will take reasonable steps to restore access to membership content when a platform issue occurs.

7. Limitation of liability

To the fullest extent permitted by law:

Our services, website, and content are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
ATFS, its founder, and its trainers and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or business opportunities, arising from your use of our services or reliance on our content.
Our total liability for any claim arising from these Terms or our services is limited to the total amount you paid to ATFS in the 12 months before the claim arose.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

8. Indemnification

You agree to indemnify and hold harmless ATFS, its founder, and its trainers and staff from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of our content, or your violation of any law or the rights of another person.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the "Last updated" date above. Material changes will also be notified by email. Changes apply from the date they are posted. Your continued use of our website or membership after a change is posted means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. Any dispute arising from these Terms or our services will be resolved in the state or federal courts located in Fulton County, Georgia, unless applicable law requires otherwise.

11. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and ATFS regarding the membership and our website, and replace any earlier understandings on those subjects.
